Q: Does my custody agreement remain in place even though the Governor has ordered us to shelter in through the Covid-19 pandemic?
A: The family courts of Allegheny County and the surrounding counties have declared that all current custody orders shall remain in place and enforceable. Of course, if you or your child's welfare or safety are in danger, an emergency motion may be filed.
Q: If I am in danger, can I get an order of protection?
A: Yes, the courts are all still open to hear and issue orders of protection. There are resources in place to support you if you or your children are in danger.
Q: What if I want to get a divorce - can I file now?
A: Yes. Most counties are available for online filing, so the divorce process can be commenced. The filing may possibly cut off liability created by a spouse such as credit card debt incurred.
Clients may consider pursuing a collaborative divorce. The Collaborative Process is ongoing, despite the courts' closure. Through the Collaborative Process, the clients have much more control over the outcome. For more information, please see https://clasplaw.org/
Q: I am afraid of getting sick and, and want to put my affairs in order. Can you help?
